Two registration systems

Land in Belize may be held under the older deeds-based system or under the Registered Land Act, which operates on a title register. Which one applies changes the diligence, the documents and the assurance a buyer can take from them.

Diligence before deposit

Searches should confirm the registered proprietor, any charges or encumbrances, boundaries against the survey plan, and whether the parcel is subject to any reservation. This is work to do before money moves, not after.

Transfer and duty

Transfers attract stamp duty and require the relevant ministerial consents in some cases. Budgeting for transfer costs at the outset avoids surprises at closing.

Holding structure

Whether to hold personally or through a company affects transfer, succession and, for clients with US obligations, reporting. This is best decided before purchase rather than restructured afterwards.

Succession

Land held in Belize passes under Belizean procedure. Owners with families or estates in California should plan for both jurisdictions together.
